Terms and Conditions of Sale for Online Purchases

These Terms and Conditions of Sale (“Terms”) govern the purchase of products (“Products”), such as caskets or urns, through the Sierra Foothills Funeral Services website at https://firebrick-bison-893064.hostingersite.com/. By placing an order (“Order”), you agree to these legally binding Terms, forming a contract between you and Sierra Foothills Funeral Services (“SF Mortuary”). Please review them carefully, as they define your rights and obligations.
1. Website and Account Usage
Your use of the website is subject to our terms and conditions and privacy policy. These Terms take precedence in any conflict regarding online purchases. To place an Order, you must create an account (“Account”) and provide accurate, up-to-date information. Use our contact page to make updates. By submitting an Order, you confirm you are the Account holder or an authorized representative and that your purchase is lawful. You agree to indemnify SF Mortuary for any claims arising from unauthorized use of contact information, including violations of the Telephone Consumer Protection Act.
2. Electronic Communications
Placing an Order serves as your electronic signature and is legally equivalent to a written signature. You agree to receive electronic communications (“Electronic Communications”), including confirmations and notices via email, text, or automated systems for non-marketing purposes. 3. Order Placement and Acceptance
Carefully review your order on the validation screen before submitting. Submitting an Order is a binding offer to purchase Products at the displayed price, plus taxes and shipping. Orders cannot be canceled once submitted. SF Mortuary accepts your Order by sending a confirmation email or by fulfilling the Order (“Order Acceptance”). If any items, such as those in our shop, are unavailable after acceptance, we will notify you and refund the item. SF Mortuary reserves the right to limit quantities. For details, see our price list.
4. Cancellations, Returns, and Refunds
SF Mortuary may cancel Orders at its discretion and issue a refund. To request a return, call 530-889-0767 within 48 hours of receiving your Product. Returned items must be unused and in original condition. You are responsible for return shipping. A 20% restocking fee applies. Refunds are issued as in-store credit and do not include shipping charges. For defective or damaged Products, call 530-823-6644 for a replacement or refund. 5. Pricing and Payment
All prices are in U.S. dollars and shown before checkout. Taxes and shipping are calculated at checkout. Payment must be made via Visa, Mastercard, or American Express. Transactions are securely processed by a third-party provider. SF Mortuary does not store card information and is not liable for processor errors. Refunds are returned to the original payment method.
6. Shipping and Ownership
We ship to U.S. addresses only. Shipping fees are based on weight and delivery preferences, and are shown at checkout. Ownership and risk of loss transfer to you upon full payment and delivery to the carrier. Products may not be exported or resold internationally.
7. Warranties and Liability
Products carry limited warranties where required by law. Full warranty details are available upon request. Unless required, SF Mortuary disclaims all implied warranties, including merchantability and fitness for purpose. Our liability is limited to the original purchase price. 8. Governing Law
These Terms are governed by California law. Any disputes must be resolved in the courts of Placer County or the U.S. District Court for the Northern District of California, subject to applicable consumer protection laws.
